Over 52 weeks the differential alone is $2,600.00. Overtime, where there is any, is computed on the regular rate including the differential, which is what 29 CFR 778.207 requires; a paystub that multiplies the base rate alone is short by half the differential on every overtime hour.

How overtime works for correctional officers

Correctional officers are law enforcement for FLSA purposes: 29 CFR 553.211(f) expressly covers security personnel in correctional institutions, so a public employer may use the section 7(k) work period under 29 CFR 553.230, owing overtime only after 171 hours in 28 days (86 in 14, 43 in 7) rather than 40 in a week. Texas TDCJ runs 7-, 8- and 9-day cycles with overtime after 43, 49 and 55 hours, which is the same rule at different period lengths. Private prison operators are under the standard 40-hour rule of 29 U.S.C. 207(a). In either case the overtime rate is built on the regular rate including the shift differential (29 CFR 778.207); New York's payroll bulletins say the same of its inconvenience pay. Federal officers are the exception: GS night pay is paid in addition to overtime and is not part of basic pay.

Federal, state and county: three different models

Federal Bureau of Prisons officers get the General Schedule statutory package: night pay of 10% for regularly scheduled work between 6 p.m. and 6 a.m. (5 U.S.C. 5545(a)), and, per the BOP's own recruiting page, 25% above regular pay for Sunday work. Both are paid on top of overtime rather than folded into it. That combination is the richest in corrections and is the reason the BOP figure is quoted so often; it does not apply to any state system.

State systems vary from nothing to $2.00 an hour. Missouri's DOC pays a $2-per-hour shift differential. Pennsylvania's DOC postings say the differential is up to $1.25 per hour. Delaware pays 5% if you work four or more hours between 6 p.m. and 8 a.m. Texas TDCJ pays no shift differential at all, only a 3% maximum-security differential. New York structures night and evening pay as annual inconvenience-pay stipends rather than an hourly rate, and separately pays a $100 weekend voluntary overtime differential. For California's CDCR and Florida's DOC we found no published figure we could cite; ask for the current amount in writing.

County jails sit at the bottom of the range. Jackson County, Michigan's POAM contract pays fifty cents an hour for second and third shift. The Martin County, Florida Sheriff's PBA contract pays two percent for officers with at least half their shift between 2300 and 0500, rising to three percent from October 2026. On a $28.34 median that 2% is $0.57 an hour, which is why the table above starts so low.

Holidays, weekends and what stacks

Holiday pay is contractual. Jackson County pays holiday pay plus time and a half on the hours worked. Martin County pays straight time for hours worked plus up to 12 hours of holiday pay. Federal officers get double time for holiday work under OPM's rules. If you are choosing between two agencies, the holiday clause can be worth more over a year than a small hourly differential.

Weekend premiums are uncommon outside the federal system's 25% Sunday rate and New York's weekend voluntary overtime differential. Where a night differential exists, it normally keeps paying on weekend nights, and it is pay for hours worked, so it belongs inside the regular rate whenever you cross the overtime threshold for your work period.

Negotiating and checking your paystub

Corrections paystubs go wrong on the work period more often than on the differential.

  • Learn your agency's work period and threshold: 171 hours per 28 days is the federal floor for 7(k); TDCJ's 43/49/55 on 7-, 8- and 9-day cycles is the same rule. Mandatory overtime does not become time and a half until you cross it.
  • If you draw a differential, the overtime rate should sit above 1.5× base by 1.5× the differential's share of your hours; a $1.25 differential on every hour lifts the overtime rate by $1.88.
  • Federal officers: check that night pay appears on overtime hours worked at night as a separate line, since it is additive, not blended.
  • Percentage differentials (Delaware 5%, Martin County 2% to 3%) rise with every step increase; flat ones need a contract reopener to move.

FAQ

Why isn't everything over 40 hours paid as overtime in corrections?

Because public correctional agencies can use the FLSA section 7(k) work period for law enforcement, which 29 CFR 553.211(f) says includes correctional security personnel: overtime is owed after 171 hours in 28 days, or the equivalent for a shorter period, such as 43 hours in a 7-day cycle at TDCJ.

What is the BOP night shift differential?

Federal BOP officers get General Schedule night pay of 10% for regularly scheduled work between 6 p.m. and 6 a.m., and the BOP says employees who must work on Sunday are paid 25% above regular pay. Both are paid on top of overtime rather than included in the overtime rate.

Does my shift differential count toward overtime?

Yes for state, county and private employers: 29 CFR 778.207(b) requires shift differentials in the regular rate whether they are a percentage or cents per hour. Federal GS night pay is the exception and is added on separately.
